Terms and Conditions Agreement

Welcome to LABDX4U.com! These terms and conditions ("Agreement") govern your use of our direct-to-consumer laboratory testing services ("Services"). By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you may not use our Services.

1. Services Provided

1.1 Description: LABDX4U offers direct-to-consumer laboratory testing services, allowing individuals to order and receive certain medical tests directly from us. These tests are all listed on our website.

1.2 Accuracy: While we strive to provide accurate and reliable results, please note that no testing method is infallible. Results may vary based on various factors including sample collection, handling, shipping, and individual health conditions. 

1.3 Lab Testing: LABDX4U utilizes well-known, reputable National lab companies to draw and process specimens.  While they strive to process specimens in a timely manner sometimes delays occur due to logistics, staff errors, limited reagents, mechanical, lost specimens, and other unforeseen issues.  These issues may delay when lab results are released, if at all.  If the labs are not processed or released, individuals will not be charged for them and have the option to return to lab location to be drawn again or be refunded.  

1.4 Lab Processing: LABDX4U can’t guarantee when lab results will be available or released.  Most of the common labs take 24-48 hrs to be available but other labs may take upwards of 2-4 weeks (lab processing facilities in California, Cleveland, Texas, Virginia).  When you take into consideration lab test ordered, logistics, shipping, and run/processing setup times then delays may occur.  LABDX4U can’t expedite lab processing or results.  LABDX4U can check on the labs ordered to possibly determine when they may be available or released.

1.5 Provider Appointments: While we try to get lab results to individuals in a timely manner do not schedule physician or provider appointments with the belief, they will be available on a certain day or time.  Individuals should either book appointments far enough out that is reasonable to receive results or wait until lab results are received.  

1.6 Medical Oversight: LABDX4U uses independent physicians/providers to provide medical oversight of test results. Any critical/priority test results will be evaluated and addressed accordingly, by a staff member or a provider, that will warrant an alert call/text/email.  The staff or provider will try connecting with the individual at least three times.  The staff or provider will need to speak to the individual or the parent/guardian of a minor to review the results, offer education and explain the next steps that should be taken. Abnormal results do not warrant an alert call and should be sent to your provider. 

Medical oversight providers do not offer medical advice, insight, diagnose, or interpret lab results. They are strictly used to review lab results and to alert individuals of critical/priority labs. 

2. Privacy and Data Security

2.1 Confidentiality: We are committed to protecting your privacy. All personal and medical information collected during the testing process will be handled in accordance with our Privacy Policy and applicable laws.

2.2 Data Security: We employ industry-standard measures to ensure the security of your data. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

3. Ordering and Payment

3.1 Ordering Process: Orders for testing can be placed through our website or mobile application. By placing an order, you agree to pay the specified fees associated with the selected tests.

3.2 Payment: Payment must be made in full at the time of ordering. We utilize payment processing companies like Square, Stripe, PayPal, and Authorize.net that accept most payment methods. Prices are subject to change without notice so visit LABDX4U.com for updated lab prices.

4. Cancellations, Refund Policy and Disputes

4.1 Cancellation: You may cancel an order before the testing process has begun and credit card transaction fees may apply. Once testing has commenced, cancellations may not be possible.

4.2 Refunds: Refunds may be issued at our discretion, depending on the circumstances of the cancellation and the stage of testing. Refunds will be processed using the original method of payment.

4.3 Disputes: You may dispute a payment with our payment processing companies (Square, Stripe, PayPal, and Authorize.net) and this could take upwards of 90 days to resolve.  All disputes will lead to the termination of your account through LABDX4U.

If you would like a refund, please email us and we will investigate it.  If a refund is deserved, then we will process it immediately and it may take 2 to 7 days to post back to the card.  

5. Use of Results

5.1 Personal Use: Test results are intended for your personal use and should not substitute for professional medical advice, diagnosis, or treatment.

5.2 Third Parties: You may authorize healthcare providers or other third parties to view your test results via fax. It is your responsibility to ensure that any authorized recipients understand the limitations and implications of the test results.

6. Limitation of Liability

6.1 Disclaimer: To the fullest extent permitted by law, LABDX4U disclaims all warranties, express or implied, regarding the Services and test results, including but not limited to accuracy, reliability, and fitness for a particular purpose. LABDX4U does not have any Patient Service Centers (PSC) or lab locations and does not draw or process lab specimens as this is through a National lab company that we contract with.

6.2 Limitation: In no event shall LABDX4U be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of or inability to use our Services.  

7. Amendments

7.1 Changes to Agreement: We reserve the right to modify this Agreement at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the Services after the posting of revisions constitutes acceptance of such changes.

8. Governing Law

8.1 Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Texas, USA, without regard to its conflict of law principles.

10. General Provisions

10.1 Entire Agreement: This Agreement constitutes the entire agreement between you and LABDX4U regarding the subject matter herein and supersedes any prior agreements or understandings.

10.2 Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

11. Force Majeure

11.1 LABDX4U’s performance under this Agreement may be subject to interruption or delay due to causes beyond its reasonable control, such as acts of God, acts of any government, war or other hostility, civil disorder, the elements, fire, explosion, pandemics, power failure, equipment failure, industrial or labor dispute, inability to obtain necessary supplies and the like.

By using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, please refrain from using our Services.
